What will it take to achieve this goal? In my view, it is the creation of a constitutional foundation for making fundamental life choices, whereby romance is no less sacred than religion. The key, as mentioned repeatedly, is the rights and liberty of conscience. University of California, the Avenger To illustrate this issue more fully, the University of California policy prohibiting faculty-student romance will now be examined. Though there are certainly more egregious policies in existence (Ohio Northern University, for example, bans all sexual contact between professors and students, except when married), the primary objective is simply to demonstrate, using the University of California policy as an example, that romance and sex are significant representatives of an essential civil liberty falling under the discretion of one’s conscience.

The answer, ironically, is simple: it shares many similarities to religion. For example, romance is no less relevant to one’s conscience than religion itself. Romance is also arguably more tempting than religious choices, requiring perhaps more internal debate. Hence, the right to think and judge, based on one’s conscience, extends to all matters of substance: speech, the press, religion, and romance, among them. Finally, though religious organizations are often at the forefront of suppressing sexual rights (and by implication, romantic rights too), they are paradoxically biting the hand that feeds them.

If we take the perspective of the founders, Madison in particular, this couple should let their respective (and collective) conscience be their guide. They should decide what they think is right, and prepare themselves for the consequences. Biblical proclamations or admonishments are relevant if, and only if, the couple chooses to make them such. It is the choice, derived from one’s conscience, that elevates the role of religion and not, as usually presumed, the other way around.
